Welcome to Yumi Matcha!

These terms and conditions ("Terms") govern your ("Customer," "you," or "your") access to and use of Yumi Matcha’s ("Yumi Matcha," "we," "us," "our") online platform (collectively, the "Platform"). If you have any questions, concerns, or comments regarding these Terms, please contact us at contact@yumimatcha.com.


GENERALLY

By accessing, viewing, and/or using the Platform, you indicate that you have read, understand, agree to, and intend to be legally bound by these Terms.

Yumi Matcha may change these Terms from time to time. Please review these Terms periodically. Your continued access to, viewing, and use of the Platform and/or our Products and Services indicates your acceptance of any updates, changes, or modifications.

By accessing and viewing the Platform, you represent that you are 18 years of age or older and of legal age to form a binding contract. If you are under 18, you represent that you have your parent’s or legal guardian’s permission to use the Platform and that they agree to these Terms on your behalf.

If you (1) do not agree to these Terms, (2) are under 18 years of age, or (3) do not have parental or guardian permission where required, you must exit the Platform immediately.


ABOUT US & OUR PLATFORM

A. What We Do
Yumi Matcha is a health and wellness company that sells a variety of matcha and wellness products ("Products"). Our Platform and Products are intended for personal, non-commercial use. Commercial use of our Products is subject to separate wholesale terms, which will be available on the Platform or provided separately to wholesalers.

B. Signing Up
To purchase our Products via subscription, you may be required to provide various information and create an account ("Account"). You must provide accurate information when signing up. If you would like to delete your account, please email us at contact@yumimatcha.com. We will delete your account within fifteen (15) calendar days of your request at no cost.


USE OF OUR PLATFORM

By viewing and/or accessing the Platform, Yumi Matcha grants you a limited license to view its content and purchase our Products.


OUR PRODUCTS

A. Our Product Offerings
We offer a variety of Products on the Platform, subject to availability and demand. From time to time, we may alter or discontinue Products, offer free gifts, or implement waiting times based on demand.

B. Product Information
Information about each Product, including usage instructions and expiration dates, will be provided on the Platform and with the Product.

C. Product Shipping
Shipping options and rates will be presented at checkout. We do not currently offer next-day air shipping in order to remain environmentally conscious. Shipping policies may change over time.

D. Product Returns
Yumi Matcha does not currently accept returns, refunds, or exchanges for ordered Products. However, if you believe your Products are damaged or not of good quality, please contact us within 72 hours of receipt at contact@yumimatcha.com. We will review all legitimate requests, but the final decision is at our sole discretion.


OUR PRODUCT COSTS

A. Individual Products
Our Products can be purchased individually, with pricing displayed on the Platform.

B. Subscription Service
We also offer subscription services, with pricing and discounts listed on the Platform. Subscriptions can be canceled within 60 days after the subscription period ends. You may request an earlier cancellation if there are extenuating circumstances. Pricing and terms may be adjusted at any time.


OUR INTELLECTUAL PROPERTY

You agree that Yumi Matcha and its affiliates own all rights to the Platform and Yumi Matcha’s trademarks, copyrights, and proprietary content (collectively "Yumi Matcha IP"). You may not copy, modify, or exploit any of Yumi Matcha’s IP for commercial purposes.


CUSTOMER CONDUCT ON PLATFORM

A. Customer Restrictions
You agree not to restrict other users, post unsolicited advertisements, transmit harmful software, or interfere with the Platform in any way.

B. Platform Monitoring
While we are not obligated to monitor the Platform, Yumi Matcha reserves the right to do so to ensure proper operation and compliance with legal requirements.


CUSTOMER REGISTRATION AND INFORMATION

You agree to provide accurate information during registration and maintain its accuracy. We may verify your identity at any time.


ELECTRONIC COMMUNICATIONS

By providing your email address, you consent to receive communications from Yumi Matcha. You can unsubscribe from promotional emails at any time.


THIRD-PARTY PRODUCTS

We may offer third-party services or products. You are responsible for reviewing their terms, and Yumi Matcha is not liable for third-party services or products.


INDEMNIFICATION

You agree to indemnify Yumi Matcha and its affiliates against any claims arising from your use of the Platform or Products.


LIMITATION OF LIABILITY

Yumi Matcha’s liability is limited to a maximum of $250. We are not responsible for indirect or consequential damages.


GOVERNING LAW

These Terms will be governed by the laws of the Netherlands.


ARBITRATION

Any disputes arising from these Terms will be resolved by binding arbitration in Amsterdam, Netherlands.


INTERPRETATION OF THESE TERMS

If any provision of these Terms is found invalid, the remaining provisions will continue to be in effect.


PRIVACY POLICY

By using our Platform and Products, you agree to the Yumi Matcha Privacy Policy, which may be updated from time to time.
